
The Decennial Insurance and the Technical control
According to " THE BUILDING CONTROL ACT 2012 (Act No. 9 of
2012)"
Every developer shall subscribe, in relation to such building
as may be prescribed: A property damage insurance policy in favor
of eventual or subsequent buyers or lessees to guarantee, for a
period of 10 years, the payment of compensation for any property
damage caused to a building by faults or defects originating in or
affecting the structural elements including the foundation,
supports, beams, framework, loading-bearing walls. Or other
structural elements and which could directly jeopardize the
building's structural soundness and stability."
According to " The Regulations made by the Minister under
sections 12 and 28 of the Investment Promotion Act" - Section 8,
point 3(b)(I) & 3(C) Obligations of PDS company:
Every PDS Company shall :
subscribe, in respect of each residential property, to
a property damage insurance policy in favour of eventual or
subsequent purchasers to guarantee
- for a period of 10 years from the date of delivery of a residential unit to the purchaser, the payment of 6 compensation for any property damage caused to a residential building by faults or defects originating in or affecting the structural elements including the foundation, supports, beams, framework, load-bearing walls or other structural elements and which could directly jeopardise the building's structural soundness and stability.
Appoint an independent quality assurance contractor
who shall
- Ensure that construction works conform with standards set out in the contract with the builder;
- And at the time of delivery of a residential property to a purchaser, deliver to that purchaser a clearance certificate stating that the construction works conform with the standards set out in the contract between the PDS Company and the builder.
Because the policy is to be issued for ten years and cannot be
cancelled during that ten year period the insurers have to be
satisfied that the risk is acceptable. : to ensure the prevention
of technical hazards that might jeopardize the soundness and the
waterproofness of buildings during the construction stage, they
request an independent quality assurance body like Apave Indian
Ocean to be involved from the beginning of the project by
undertaking documentary analysis of construction drawings and soil
investigation reports in view of preparing risk definition reports
(RD0) for the insurers to carry out regular site visits to VERIFY
the quality of works the construction phase and provide a
final risk definition report (RD6) that would allow insurers and
re-insurers to set up the decennial warranty.
